The Missouri Merchandising Practices Act (MMPA)
The MMPA (Section 407.020 et seq. of the Missouri Revised Statutes) serves as Missouri’s primary privacy enforcement tool. Often described as Missouri’s “mini FTC Act,” it prohibits any deception, fraud, false pretense, misrepresentation, unfair practice, or concealment of material facts in connection with the sale or advertisement of merchandise. Missouri courts have interpreted “unfair practice” to be broadly encompassing.
The MMPA is enforced in two ways:
- By the Missouri Attorney General,who may seek injunctive relief, restitution, civil penalties, and disgorgement of profits.
- By private plaintiffswho purchase merchandise for personal or household use, who may recover actual damages, and in some cases punitive damages and attorneys’ fees.
Data Breach Notification
Missouri law requires that any business owning or licensing personal information of Missouri residents notify affected individuals without unreasonable delay in the event of a security breach. Notification to the Missouri Attorney General is also required. Covered personal information includes a name combined with a Social Security number, driver’s license number, financial account information, or medical information.

7. Store Policies
Refund Policy
All purchases are subject to a store credit-only policy — we do not issue cash refunds under any circumstances.
Live Fish
Live fish carry a 48-hour live guarantee. If your fish does not survive within 48 hours of purchase, we’ll make it right with store credit — provided the following conditions are met:
- Photo or video evidence of the deceased fish is submitted within the 48-hour window
- A water sample must be brought in-store for testing, showing water parameters are within acceptable range
Claims that fall outside this window, or where water quality cannot be confirmed, are not eligible for store credit.
Rodents
Rodents may be returned the day of purchase or the following day with prior phone contact. A valid receipt is required at the time of return. The animal must be free of any signs of injury or attack at the time of return. Returns will not be accepted if the rodent has been attacked or shows visible signs of harm. Store credit will be issued upon return and must be used within 30 days of issuance.
Dry Goods and Shelf Merchandise
Dry goods may be returned within 30 days of purchase with a valid receipt. Items must be unopened, in original packaging, and in resalable condition. We do not accept returns on any item that has been opened or used. Store credit will be issued upon inspection and approval of the returned item. All store credit must be used within 90 days of issuance and cannot be reissued or extended.
